If Plusnet sends a letter to someone claiming that they have downloaded content in an illegal manner, don't Plusnet lay themselves open to a charge of libel, since they have no proof that the action took place?

Sam Jardine, an associate at international law firm Eversheds, argued that the £1,000 fine was a "token slap on the wrist for a broken business".

IMHO even more important than the penalty is his card being marked by one more authority.

Its obvious that the ICO do not put much value on a persons data security.
I bet it cost Plusnet more than that  providing the customers affected with the identity theft protection.
Absolutely disgusting but we all know the ICO are weak and if you did not you know it now.

What protection - BT emailed, unencrypted, a load of personal details.

The first person in Scotland to be convicted of downloading music illegally has been put on probation for three years.

The search also revealed that she was part of a "sharing hub", which meant users within her network could download music from her.
Muir pleaded guilty to a charge of distributing articles which she had reason to believe were copyrighted without a licence, to such an extent as to affect the owner of the copyright.
At an earlier hearing, defence lawyer Lorenzo Alonzi said his client had not used the network for financial gain but to build up her self-esteem.
"She has expressed genuine remorse for this and is severely embarrassed about it," he added.

Was the sentence made more recently, or is this just an old piece of 'news'?

Fraudulent Preference
A Fraudulent Preference is for example where someone who is insolvent chooses to pay one creditor knowing there is not enough money to pay the others.

IIRC only if a creditor has put particular pressure on for repayment, will assets passed avoid the transaction being wound back. No doubt HMRC will also ensure they get as much as they can out of him. As to house in particular, if not immediately saleable, it can become subject to a charging order.
In other words; he isn't neccessarily out of the woods next.

That's up to the receiver/trustee and assumes it is not on lease?
