Personally, I believe this could easily be classed as miss selling if taken to tribunal or given to the ombudsman regardless of the terms.

The fact of the matter is that this is happening to many people, and neither businesses promotions appear as actively regulated in such a way that protects the consumer - who is responsible when both deny involvement, one person may say Plus net, one may say Quid co, both could be right or wrong but essentially what does it matter as the only body who could make a relevant decision would be an ombudsman or trading standards agency which could take significant time and energy to pursue. Meanwhile my £30 a month is securely contracted and in Plus net’s pocket. For this reason, feeling duped I politely requested early exit if this is not concluded and this was also denied.

Back to my original sentiment, this is to warn anyone else who is in the same situation as myself - feeling mis lead and hung out to dry. There is no conclusion here for the poor marketing practises, don’t waste your time - Quid co and/or Plus net win, …remember that incentive you took to get you in the door - ‘ha ha fooled you!’

I have added the Quidco response to the escalation.  It is apparent that both party's first line support are doing what might be thought reasonable...

  • PlusNet: you are NOT entitled to a reward card and you speak to Quidco about the cashback
  • Quidco: we do not deal with reward cards, speak to Plusnet about those

... these positions are correct and valid, however in the context of Quidco stating that you can have both, what is required is escalation to owning managers on both sides.  I can confirm that Plusnet is acting in this manner, one awaits their findings.

However what cannot be denied is that Quidco are not accepting that you engaged with THEIR misleading advertisement and that is a matter for them to deal with in a professional manner.  Have to made such clear to them, rather than chasing your tail with "Plusnet are not honouring the reward card"?  Have you said to Quidco that there advertisement was misleading and a potential case to refer to the ASA if Quidco do not address your valid issue with them?

The Advertising Codes require that advertisers hold evidence to prove the claims that they make before they are published or aired. We expect all advertisers to follow the rules when creating their ad campaigns.

Even though many steps are taken to ensure ads are in line with the Codes before they are aired or published, consumers have the right to complain about ads they have seen, which they believe to be misleading, harmful or offensive.

The ASA can act on just one complaint. We don’t play a numbers game: our concern is whether the ad rules have been broken.

You need to challenge Quidco for their evidence that the claims they made in respect of what they advertised - both incentives were payable - which induced you to purchase were valid.  It is evident that what they claimed in their advert is misleading and has placed you in a detrimental position compared to the expectation you were given.  Therefore they are in breach of the ASA code.

Superusers are not staff, but they do have a direct line of communication into the business in order to raise issues, concerns and feedback from the community.

Out of interest when you placed your order did the Plusnet basket show reference to the reward card through the whole checkout process?

Hi, I am afraid I didn’t note whether it did or didn’t, sorry - we were content it was the link followed from Quidco though so wouldn’t of been looking for whether it was stated to be included/ omitted.
