I would agree it sounds like poor advice, but if you read the the details of the leaked emails from ACS, they never took a single person to court, and had no intention of... because they knew they could never win, and it would cost too much money! Also, they never chased those who didn't reply either. They only dealt with those who replied, either to deny it, or to pay up. To those who replied to deny it, got sent more threatening letters, hoping to scare them into paying, but ACS haven't followed up those who didn't reply at all. So that seems to be the way out of further hassles!
So normally, ignoring a letter from a solicitor would be very bad advice, but this isn't a normal solicitor, it is a money making scammer! Just ignore him for now seems up be the best bet.
BUT, do your own reading, and make your own decision, since I could well be talking rubbish, and it is your life, reputation, and money at stake, not mine! You follow my advice at your own risk, but it seems to be the common consensus on the reading I have done. Your findings might vary!
The official answer had to be to seek your own professional legal advice, but that costs money.

Please read the being threaten website, ignoring these letters could be your short cut to be found guilty, we do not know what the future holds or whether ACS:Law will seek to monetise the people that ignored them, but we do know that not replying puts you in a bad position should it ever go to court.  So don't ignore a letter from ACS even if it looks like the best short term option, the future is unknown, the legal system is not.

Gets a couple of mentions on BBC Breakfast this morning highlighting SKY but mentioning BT and 'other ISPs'
The Information Commissioner appeared on the show and made some general comments about data protection but nothing specific.

Well it was the first thing I done and I've still to get a reply from you cowboys. I'd like to know exactly what data PN have given put without consent and why I was listed in the first place.
All news reports are about people being attached to porn torrents,which worries me as I have never downloaded a porn torrent in my life.

I'll take a look when I get to the office foxtrk but it's worth people noting that it can take a day or so to get round to responding to any queries. We'll only have had skeleton staff on last night and they'll have been told to steer clear of the ACS:Law enquiries until those who've been working closely with things get back to the office.

But with the articles rather missing the point about what they'd supposedly downloaded.
Fortunately I've not seen an email - presumably it would have gone to my email address as shown on the Account Details page of the portal?

Yes the same email address that is now publicly available to thousands. Thanks PN.  Im just going to download the list myself rather than wait for a response from PN, maybe I'd find out faster!

I received the letter, and i feel that Plusnet and Fletch in particular have been the most pro-active ISP regarding this. I dont know of any other ISP that has sent an email to everyone they have  given the names and addresses of. There may be thousands of people out there who dont know that their details have been leaked, (Sky I am talking about you) and have been exposed to potential blackmail.
Again thanks Fletch and Plusnet for at least "shutting the stable door after the horse has bolted".

Dear PN,
Please state if the details of your customers you sent to ACSLaw were sent in full accordance with the DPA?
On 10, from http://www.plus.net/support/acslaw.shtml, it is not clear.
So the information was sent securely to ACS Law?

Uh, this maybe because once they are aware of a DPA breach they are required to inform people who may have been affected, this is highly unlikely to be a sudden ability to find a spine.

Well, sort of, but not exactly. The way I see it, if it was sent in an encrypted form by PN (BT) but then it was emailed around ACS:Law internally after they decrypted it., then that is most likely how the contact details are now avaiable to all. If, on the other hand, PN did NOT send the file in an encrypted format, then it's likely that PN might be held responsible, as the NPO clearly states that it needs to be encrypted.
So depending on when (or indeed if) the file was encrypted and then decrypted, that will determine who is responsible for the details being publicly visible.

I'd suggest anyone who has received an email should be asking Plusnet by raising a ticket if the data about them was transmitted between Plusnet and BT, and BT and ACS Law in a secure encrypted format.
