OpenReach Trespass

OpenReach has twice now installed equipment for neighbours under my lawn without consulting me and have no legal basis to do so (I’ve asked for it but never get an answer). Everything I read states they have to have my agreement.  Neither OFCOM nor the Ombudsman are regulators of this organisation so to whom do I report it…?  Having to fund legal action to undo something like this seems preposterous.

Re: OpenReach Trespass

Did you confront them when they were doing this, and if so, what did they say? From my limited knowledge on this subject, they cannot do this without your express permission.

Do you mean they dug up your lawn ?

or they used existing ducting already installed under your lawn ?

Re: OpenReach Trespass

I was away the first time and found the cable about 2cm under the mud and noticed some of my plants had been turned upside down.  No one at OpenReach would speak to me because I wasn’t the customer.  I called in a fault and someone appeared within 2 hours, said it was indefensible and I asked him to remove the cable - he did, but OpenReach didn’t really comment on anything apart from ‘it’s been sorted, sorry’.

The supervisor texted me the following some time after:

There isn’t a process available to me to separately register the removal of the cable. I have, however, informed the complaints team that the cable has been removed, so they are aware of the current situation.

The next step will be for your neighbour to wait for his installation appointment. When the appropriate team attends, they will be able to confirm that there is currently no cable in place and re-plan the work accordingly.

This will allow the correct job pack and associated permissions/wayleaves to be put in place before any civils work is passed to my team. We can then ensure that any work is carried out in the correct location and with the appropriate permissions in place.

I have also contacted the fibre team directly to explain the situation so that they are aware of what has happened and what will be required going forward.

Apologies for any confusion caused.

Weeks go by and I’m away again and return to find the cable is still under the lawn but now in a duct (which is mine) and branches off to the neighbour.  A formal complaint was made as again, I knew nothing about it.  OpenReach is stalling now to give me a final written resolution as they don’t want to follow the original plan which was for a duct to be put in the neighbour’s land.

Re: OpenReach Trespass

Hi, see my latest reply.  They used existing duct on my land and then dug another trough to branch off to my neighbour’s land

Re: OpenReach Trespass

Well it certainly sounds like they (Openreach) should have requested a formal wayleave agreement and should not have installed anything without it.

There MAY be an historic wayleave, if so it should be recorded by the Land registry

Re: OpenReach Trespass

I checked with the archive team at OpenReach and they twice said nothing was registered.  Nothing shows on the title or conveyance either.  I got this from Complaints:

I would like to confirm this is not the final email to your complaint.

Following a site visit, we have confirmed that the work carried out did not follow the approved plans and that activity took place within your property boundary when it should not have. We sincerely apologise for this.

We have arranged for the work to be re-issued as a defect, and a civils manager has taken ownership of the case. The team will return to rectify the work and ensure it is completed in line with the agreed plans, without using your ducting or carrying out unnecessary work within your garden.

We appreciate that this issue has reoccurred after previous efforts to resolve it, and we understand your frustration. We will provide you the formal response post the rectification is completed.

The problem is, they could take years to rectify it and hope it goes away 🫨

Re: OpenReach Trespass

Sounds like they've accepted they're in the wrong. If you don't get any action , then I suggest an email to the Openreach CEO, that usually gets things moving.

Use ceomail.com to find the name & email address
