Data Breach - wil be reporting to the ICO

On 2nd October I clicked the link to opt out of transfer to Greenby and was assured by an automated response the transfer of my account would not go ahead and my e-mail would be closed instead.

 

I have just received a welcome message from Greenby showing they have been given my data against my expressed wishes. I will report this to the ICO.

Oh come on, annoying but not the end of the world. You get what you pay for and PN email was always free, which is why I didn't bother signing up when I saw its convoluted system. Tell Greenby that you don't want it, and to delete your details. You'll find a reliable supplier for a few pounds a year.

I agree that it should not have happened. However, as this thread seems to be going all legal, it's worth looking at the contract Ts and Cs relating to passing data to other organisations::

19. Other things we need to tell you

19.1. Dealing with this agreement: You accept that our agreement is just between you and us, no one else can enforce it and you can transfer it only with our consent. However, we may take instructions from a person acting with your permission. We can transfer our agreement to another company provided this does not adversely affect your rights under the agreement.

However if someone explicitly opted out of a service transfer it should be honoured.
You can check out but you can never leave ( easily)
