Why am I restricted to 38Mbps?

I must admit I was very surprised as well, when I did the diagnostic checks with BT and found that the line had far greater potential than what I was told by the guy who I spoke to about my then at the ADSL line speed dropping to between 1 & 2 Mbps, he assured me that 38 Mbps was all that I could get on my line.
Now I have made the necessary enquiries about the improved line speed and OK it's going to cost a fiver more and it will be upgraded in a months time.

PS. I would have responded earlier, but for some reason I lost my connection to the internet for about 10 or so minutes.
