...There is some degree of irony in BT's lawyers seeking an adjournment on the security front, since it was discovered that Plusnet customer information had been passed onto ACS:Law via BT in an unencrypted format. The resultant uproar would appear to have made BT more careful and less trusting of third parties obtaining court orders to reveal customer information. Interestingly there are now calls for a test case, which we would presume is lawyers and firms now questioning how accurate IP tracking software used in these cases is.
Worryingly, Gallant Macmillan are asking for some of the details of the January case to be conducted in private for security reasons. The worry here would appear to be that if details of how they store data obtained via the court order became public, it may attract people to attack it to try and obtain it. Hopefully this will not result in the parts of the case where accuracy of the IP data is called into question, or other parts of the case that are of clear public interest being held in private....

NEWS:
As the new Legal Ombudsman opened the gates today at 8:30AM, one of the very first complaints was against Gallant Macmillan, the London law firm capitalising on ACS:Law's dubious legacy.

Ministry of Sound is confident it will eventually get the information it wants from BT-owned internet service provider (ISP) PlusNet.

This news report is indicating that both innocent and guilty people are being caught by the Ministry of Sounds tracking method, but the Ministry say “"We can't afford to have our business and artists stolen from us any more and we have to take some action."
I would have thought that the estimated revenue of £136m is not going to be dented by a single infringer and that a more tactful approach would be better PR for such a large company. Would it not have been better to pursue repeat offenders?
The Ministry of Sound have said on the Radio this morning that they “will continue until habits have changed”
So their aim is to educate the internet subscribers? By sending them a pay up or go to court letter? I personally don’t think this is a good way to approach the problem of file sharing and nor does the BPI who also said that it “does support the sending of letters, but "as notifications, as outlined in the Digital Britain proposals".
I'm amazed that larger companies feel the need to flex their muscle at their customers as a whole and not lead the way in providing a better way to combat piracy.

Since this "Ministry of Sound" have a legitimate revenue generating presence on the internet aren't they taking a bit of a chance that they might face a DDoS such as the one that brought ACS:Law to its knees?

On behalf of the Plusnet Usergroup, I would like to arrange a customer presence opposite the high court on the 11th.  If you're interested in taking part, please PM me your email address and I'll keep you informed of what we're planning.
Given the press may well be in attendance I think it would be an excellent opportunity to put across the users views in real-time.

First stage would be to double check the court date (with someone that was actually there and who took very accurate notes).
Two dates have been mentioned - the 11th and the 12th.
The first 'tweet' mentioned the 12th as did the Guardian article. The BBC and Plusnet have been talking about the 11th.
It'd be a bit sad if a crowd of people travelled to London on the wrong day - maybe Fletch would confirm as he was there.  Smiley

Hi Fletch, what do you think to BT's claim that they never sold any BT customers details to ACS:Law?  Does that mean that they don't consider PlusNet customers as BT customers?

Re: Plusnet will give your personal details to ACS Law with not informing you!!

The details were never offered for sale, a court ordered they be handed over, Plusnet/BT then decided not to charge for the work they did.  In future though they probably will.
But free or charged, if a court order forced you to hand over your home to the council, would you feel that you had sold it?
