Re: Plusnet will give your personal details to ACS Law with not informing you!!

I cant believe i am resurecting this thread! we all thought that we had seen the back of speculative invoicing when we got Andrew crossley of ACS Law banned and fined, but no it not over yet.....
http://www.openrightsgroup.org/blog/2012/speculative-invoicing-returns
Golden Eye international are back trying to get an NPO against many thousands of internet users.
can someone at plusnet confirm or deny that plusnet /  BT are not involvbed. if they are a named party then i hope (after what happened last time, that you sat back and did nothing to stop the NPOs being issued despite many posts telling you what was going on) that you will send someone to the court next week when the case resumes to defend your customers. at the moment i can only see that O2 Telephonica are implicated.
remember THEY HAVE NO MORE EVIDENCE THAN ACS LAW - AN IP ADDRESS.

What would be the policy of Plusnet / BT if they are approached by one of these speculative invoicing cowboys?

We haven't been approached and the latest NPO hasn't been granted. A lot was learnt from the ACS:Law debacle though so I'm sure there'd be a reasonable amount of resistance on our part.

Well that's good to hear, thank you. I can't believe this whole thing is still going on in one form or another. I guess if someone thinks a quick buck is there to be made, they'll do what they can to make it.
Hopefully a bit of knowledge and some common sense will prevail again, and this latest group will go the way of Andrew Crossley.

It's a relatively easy way to put the frighteners on someone.

Thanks for the reply Bob, I will keep an eye on what happens when they resume the application and report back

Closest I can see is http://www.openrightsgroup.org/blog/2012/golden-eye-in-court which says that Golden Eye International (who are surely infringing on the estate of the late Ian Flemming?) have a week to respond to concerns raised by Consumer Focus.
Which would be this Friday by my calendar.

Yet, and I'd be disappointed/surprised if it was TBH.

Re: Plusnet will give your personal details to ACS Law with not informing you!!

Update:
O2 and Golden Eye International in court battle over user details
[quote="ORG"]
ORG applies to intervene in Golden Eye case - and we need your help
We want to do more to promote digital rights like privacy through interventions in relevant court cases.
As part of that ambition, we have applied for permission to intervene in the appeal of the Golden Eye International v Telefonica UK decision. And we need your help to take this important case.
Intervening in these sort of cases is expensive. But we also think it's really important that we try to represent the interests of Internet users in these situations. If the decision goes our way, we believe one consequence will be a more robust process for considering the data protection rights of those who pay the bill for an Internet connection.
It would be harder for firms like Golden Eye to represent large numbers of copyright owners. So it would, we believe, be much more difficult for firms to send very high numbers of letters accusing people of copyright infringement and asking for a disproportionate compensation under threat of a court action.
Previous schemes by solicitiors, based on similar revenue sharing arrangements, have been called 'speculative invoicing' campaigns – you may have heard of ACS:Law, for example. We believe this would be a further blow against such schemes.

Did a 138 page thread need to be resurrected for this?
