The small claims court does not not set a legal precedent, but it is a good start.

a bit concerning they waited 12 months for BT/Duffnet to respond?
Usually you can ask for a judgement by default if they haven't responded to your initial claim within a reasonable timeframe - typically as little as 14 days, but usually 21 or 28 days.
Not quite true AlaricAdair, as when/if a case gets defended, then it is submitted to a county court of your choice (as an individual taking a company to court, the court service make it as hassle free as they can, so the plaintiff just has to concentrate on the legal stuff).
At this point, because you are not challenging a previously unheard understanding of a legal point of law, then it's nothing to with setting legal precedent, it will all be about consumer law, law of contract and breaches thereof, of which there is a ton of evidence alone on this forum.
Plumnet/BT defence will be their terms of the contract.
Your claim will be that certain parts of that contract are invalid or unfair, which gives leave to realease you from that contract without penalty and allow you to claim reasonable costs for having to take legal action to get them to see sense.

The customer doesn't ring a bell, but it may be worth noting that he used small claims rather than CISAS - our typical points of contact for alternative dispute resolution.
