Split off topic relating to legal redress if BT Openreach don't turn up

You may find http://www.moneysavingexpert.com/shopping/delivery-rights an interesting read if you have to take a second day off work.

Split off topic relating to legal redress if BT Openreach don't turn up

Quote
Either way, its not REALLY Plusnets fault, its Openreach

Err, No. The contract is between the customer and Plusnet. If Plusnet get Joe Blogs to do the work and they fail to do it, one can't pass the buck and say it's not our fault, our contractor let us down.

Indeed. This has been discussed before.
The failing of Openreach are well known, equally PlusNet have not dealt with this known "shortcoming" adequately by any sort of proactive management.
PN seem to be able to recover problems reasonably well, but would surely be better served by putting more of that effort into prevention.
As someone who has had to deal regularly with assorted parts of BT over very many years I've learnt the value, indeed absolute necessity of "managing" BT.
Sorry, I'm wrong - Micro-managing.  Cry

Re: Plusnet are LYING to me

It would help if Plusnet gave users the full compensation they are legally entitled to (e.g. a days pay when they have to take a second day off work due to a failure of the engineer to attend the first appointment) and charged that back to OpenRetch.

According to which legislation?
This situation is largely regrettable and I'm really sorry for the fact that it has happened in the first place, but giving people false hope re compensation serves noone.
Openreach are never going to cover loss of earnings for a residential service.
Either way, this is largely off topic and knowing Chris, he'll do whatever he can do to get things sorted.

Polite reminder, this is PlusNet's problem, not Openreach.
If OR aren't delivering adequately to PN (and customer) expectations that's a commercial issue between PN and OR.
The customers redress is from PlusNet.
How PN choose to manage the risk is up to them. On the one hand they could just let OR carry on and pay substantial compensation to customers, on the other they could actively manage OR or even claim back the compensation they pay to customers resulting from OR failings.
Like any such situation it's a balance of risks and costs.  Wink

Re: Plusnet are LYING to me

Yes and I completely accept that. It is up to us to deal with the problems that have been experienced, however we have a contract with Openreach which will cover these scenarios, but will not extend to loss of earnings.  As you have said - this is our problem.
I am more keen to avoid "legal rights" being incorrectly presented in a forum which some may deem as gospel.

Maybe, but a claim for loss of earnings may indeed be totally reasonable in such situations if an agreement can't be reached between the parties on suitable redress for the failure of an engineer to attend as agreed.

I've read it and other similar references before and know the position fairly well.
One thing people commonly forget (or choose to ignore) is:

You're expected to try to minimise your loss

a position that also commonly applies to insurance claims.

Though insurance companies actually expect a lot of their customers to exaggerate / maximise their claims!
More seriously though, to make any claim you pretty much need to demonstrate a direct consequential loss for the 'no-show' (breach of contract).
