I guess so, but they will need to remove the option on the SIM to disable the menu on your phone.
I assume it can be done by a OTA (over the air) SIM update?

No restrictions for tethering/hotspot from your phone anymore.
Even though it was against their rules, hotspot from phones has always worked.
