Under which legal conditions (do you not need a TV license) ??

As per title
I have a client that bought a TV with built in freeview, to use as a monitor with their PC as it was on special offer, & cheaper than the same sized monitor in the same store
He never watches TV unless over friends / family,
Yet he only listens to the radio stations, when not using the PC
Which means the TV is capable of broadcasting TV stations via coaxial aerial, (due to they can  not be omitted from being tuned in)
Where does he stand ?? ?? ?Huh

As I understand it it used to be that a licence was needed for equipment capable of receiving such transmissions.
Also retailers were obliged by law to take the address of anyone purchasing receiving equipment and pass it on to the relevant organisation (TV Licensing).
That is now not the case.

If he could prove he doesn't use the TV to watch broadcast shows, then he should be golden .. the problem would be how to prove it.
Maybe he could ensure there are no aerials or coax cables in his house?  The TV Licensing agents are empowered to enter the premises to check.
Apparently, the requirement for TV vendors to provide names and addresses of buyters to the licensing authority was removed in June last year so it may be some time until they get around to checking on him.

The following clarifies things a bit more:

Bit daft anyway what would stop someone giving a duff address ? Equally would a small shop refuse to sell a set to someone who refused to give their name and address, probably sell it and fill a duff name and address in themselves rather than lose a sale.
No Limit to the number of tv's under one license at the same address so hundreds of TV could be licensed to a single address and once the license was shown they would have no legal right of entry to the premises.

@ Mav..... your first quote..... yeah..... sort of .. clarifies it a bit.... however... how can you prove that you DON`T watch LIVE progs or record LIVE progs ?  I suppose, one way is  to make sure you unplug the aerial lead, everytime you get a knock on the door,... just in case it is the TV PLOD...  Cheesy

I think it's a misconception that you have to prove you don't watch live TV. TV Licensing have to prove you do.

As has been pointed out the rules changed - for example one is no longer asked to fill in a form, in shop, when buying tv or monitor.
People will have noticed, when using iPlayer, that one is reminded about need for licence when clicking on iive broadcast.
Subject has often been debated on NOWTV forums as it is possible to also watch some live Sky transmissions which do not give a reminder.
One advantage of being old is that the nice people send one a free licence every three years  Smiley
