Movie piracy

Is downloading from/via www.mvgroup.org (educational P2P) classified as piracy?
There are some good educational documentaries.

If the material being offered is free from copyright then no problem, if the copyright allows downloading then no problem (if the copyright holder has agreed for the material to be available for free download or even contributed it to the site), if the material is not there with the permission of the copyright holder then problem.
However good the intent, copyright is legally enforceable and the copyright holder does have rights regarding what is done with what they have produced (or for payment if appropriate).
