virgin media latency an there shod CS, fault repairs

not really the place to post this but am fed up of fighting with VM's fault raising system, even tho my latency, jitter is beyond being able to game with they just say the utilization levels on my ubr is within there set limits and so cant raise a fault.
so this is a big heads up, do not head towards VM if your a gamer, i heard the rumors before i joined but i never imagined it would be this bad

as you can see in the post i linked to i was planning on posting the graph here under the pre tense it was a PN connection to get confirmation that a other isp would raise a fault when a customer gets such bad latency, i all ready know what would happen over here if capacity was being hammered to the point latency was effected on priority packets to the levels am getting.
probably just scan the forum for the old adsl2 trail thread i had and show em what true CS is like

Could be their "dumb" traffic management switches being swamped?
Your not on the top package, which has no management (yet)
I know of a few people on VM who get no issues at all - but they're on the top package.
VM has their own network - and barrel loads of debt (thanks NTL + Telewest) so I would never expect a fast, well-thought through solution to any issues like this. Their cable networks just over subscribed, Just like BT - but at least theyre finally putting some money into it

far to long 
there switch are located at the hops with tmr in them, 50mb now has upload usage period of 5 while 8 or 9 i think, and also all packages have the p2p management applied even 100meg.
It's defo over utilization on the ubr am connected to, all yestrday was appalling man and others that get told to upgrade do so and still have the same results due to being connected to the same ubr as before, they need to get some more ctms's online to cope with new sells they keep taking on in over subscribed areas.
best i can hope for is when the 100 meg upgrade hits oldham in sept, hopefully the new lazers an amps will improve my baseline latency some and fingers crossed they improve capacity at the ubr's at the same time
when i got disconcted for week over a random DD cancel order that the bank an virgin deny anything to do with happened, on getting service back on they put me on a different upstream feq (well AUTO system AS THEY CLAIM THEY CANT DO THIS manualy) i no longer saw the eve increase in latency but since then things have got worse than before, so it only took about a month for that feq to become over utilized
