Potentially yes. Downloading requires some upload bandwidth to confirm/acknowledge successful receipt of data; conversely uploading requires a small amount of download bandwidth for the same purpose.
Taking a simplistic view of the situation, and assuming maximum sync rates are achieved in both directions, downloading at 38Mbps (38000kbps) will take around 750kbps upload bandwidth out of the available 1900kbps.
That's around 40%, but I emphasise this is a very simplistic analysis.
