Honesty is the best policy, and Clause 18.1.1 cannot apply however you look at it. It isn't an arguable point.

Well a lot of it is particularly BT etc. saying increases in speed from the 38/40 to 52 when most of us will see no increase.

Clause 18.1.1 does apply, however it would be considered an unfair term. Catch all clauses like 'we can change the service if we change the service' (which in lay terms is what 18.1.1 is saying) are frowned on by the courts, so anyone facing any cessation charges can take it to the Small Claims Court.

I have now moved to EE, who are offering 38/10 for less than PN's 55/10, and as the extra download is of no benefit to me, it's a no brainer. I will see what happens when I get my final bill from PN, but if there are any charges that are not covered by EE's £50 buy-out offer, I will be taking PN to the small claims court.

You do know that EE are owned by BT as Plusnet are, that's a downside I would guess 😞

Yes, and it is one of the reasons I went with them! I have been with PN for about 10 years, and their reliability has been exceptional; I have only twice been without internet for more than a few minutes, once when a BT underground junction box flooded, and once when there was a major outage that affected multiple ISPs. The only beef I have with PN is them downgrading my service.

There are several ISPs who are cheaper than EE, but they have terrible reliability and customer service records.

I'm on 40/10 and I do benefit from the change; 10% increase in downstream, and upstream unaffected. I can't be the only one ...

Max: Upstream rate = 7196 Kbps, Downstream rate = 44105 Kbps
Bearer: 0, Upstream rate = 7196 Kbps, Downstream rate = 40000 Kbps

Are they changing people currently on 40/10? I thought it was just those on 40/20.

40/10 still exists from BTWholesale, but 40/20 never did and it never made much sense to offer 40/20 while having to pay the wholesale costs for 80/20.

As I understand it  we have to be getting now the full 40 Mbs to see any increase in this maximum new speed of 55 Mbs, you are one of those then with a very good line and not far from the cabinet.

Those of us further from the cabinet thus not getting the 40 Mbs like myself of 31 Mbs will see no increase, surely we will be in the majority.

Although, looking at the estimates for your line, you also won't see a decrease in upload speed from 20Mbps to 10Mbps. It appears your fibre service will essentially be unaffected:

40/20 to 55/10

The day has come.  At the moment, my modem is still synced at 59/17 mbps - I did power cycle the modem in the early hours of this morning.  

Only change I can see is the upload speed tests are now being capped at 9.5 mbps.  

Download speed is still 56mbps as it has been for past two months, mysteriously bumped up from 38mbps, around the same time I was moved to the 'New Network'.

ex-Plusnet (ADSL, FTTC) 2008-2023. now BT (FTTP) 2023-

99% of people will see NO increase of speed , and will only notice a upload loss Sad

Just a cost cutting exercise by PN by lowering upload bandwidth, Shame on PN trying to fool people into thinking they will gain upload speed
