I think it only really 'bothers' about CRC errors (ES and SES).

Trying to think of possible ways, I don't think you'd have too much to loose if you changed to the 40Mb/s product, now
if you could get that provisioned as 40/10 I'd expect such a change to reset the DLM and you could always upgrade back to 80/20 later (this will probably reset your 18 month contract period though).
