One of the things that live musicians object to is that a band of more than two live musicians Smiley can't play in a pub which has no Public Entertainment Licence, but that pub won't need a licence to deafen its customers with its television or canned music, which is obviously being served up as public entertainment.

Yeah, but you can always turn the TV or canned music down or go to an area where the TV isn't. Why use the open areas of pubs anyway for live poerformances? Why not use a separate area where people can go if the actually want to listen?

In my experience such performances significantly outweigh canned music in their intrusive noise levels, which is fine if you like the performance but no good if you don't. And if you just went there for a pint or two after a bad day maybe that could be just what you don't want.
