If you read as far as paragraph 72 of the ICO report, you will discover that Ofcom decided that the PLT devices under investigation were compliant with the EMC directives.
However at the time of testing there was no harmonised test standard, therefore testing was done to a 'reference' standard.  Until a recognised harmonised test standard exists one cannot claim that any device is not compliant with EMC standards.  Huh
