Nope, they've not. It's a hack.

It that is the iplayer thing, then I thought they'd blocked it already?

That's the funny thing!
The Beeb were in such a rush to provide content for the iPhone, that they originally supplied a DRM free download if you changed your browser settings (user agent) to imitate an iPhone.
This was subsequently blocked.
They still supply a hidden URL to a DRM free download.
This is "security" by obfuscation - when does a trivial derivation of a URL become a hack?
In any case, I've paid my tv licence, so I would argue that what I did was perfectly legal - after all if I had an iPhone (who does?) it would do exactly the same thing.
